If you have already found a property you would like to purchase but negotiations have broken down, you may want to consider our property mediation service. It works very like our property sale management and property search service except that both services are operating independently in parallel. Our independent Pre-Purchase and Pre- sale Opinions often assist by acting as a reality-check for both parties as to the advantages and disadvantages of the property in question and so both parties have a clear idea of what a realistic market value of the property in question is, enabling them both to move forward with their respective offers.

We start by inspecting the property and preparing Biloba’s Confidential Pre-sale Opinion for the potential seller at a cost that starts from £500 depending on the size and location of the property.

If there is no work to be done on the property, agree with the potential seller a Confidential Strategic Pricing and Sale Plan together with the Seller’s Disclosure Notice setting out the information which the potential Seller wishes us to disclose to the potential buyer.

Around the same time and before any viewing, we draw up the potential buyer’s Disclosure Notice setting out the information it wishes us to share with potential seller.

When both parties’ Disclosure Notices are complete and have been approved, we are then able to arrange an exclusive private viewing of the property for the potential buyer only preferably staged for maximum impact at a cost £200 plus expenses.

Only information contained in the Seller’s or Buyer’s Disclosure Notices can be shared during the viewing. Any queries by either side relating to further information can only be dealt with subsequently by us following a consultation with the relevant party and obtaining their express consent in writing. Consequently, we recommend that following the viewing both sides to submit a list of further questions in writing for the other side to answer.

Following the viewing we can prepare Biloba’s Confidential Pre-purchase Opinion for the potential buyer at a cost starting at £500 depending on the size and location.

Neither of Biloba’s opinions or their contents is disclosed to the other party unless one or other or both give express written consent to do so. It should also be remembered that the views expressed in Biloba’s opinion are matters of opinion and that others could take a different view.

Throughout the negotiations we are very aware that in our role as a mediator we must treat information received from either the potential seller or potential buyer as completely client confidential and it is a responsibility we take very seriously.

Our managing director, Jessica Tennet, will personally act as your mediator. Her training and experience as a barrister and a mediator enables her to recognise the sensitivity of the information being sought and/or disclosed to us on both sides during the process and ensures there is no disclosure via us from the potential seller to the potential buyer or vice versa (such as the potential seller’s the bottom line or the potential buyer’s maximum price or reason for selling or buying) without first obtaining express written consent in relation to any specific disclosure. Given these safeguards we are confident that we can achieve the combined sale and purchase of a property through mediation with both parties directly (or through their professional representatives if preferred) which meets with both parties’ expectations.
